Insurance Department

Our insurance department has extensive experience in advising leading financial institutions, corporations, and insurers on their most complex transactions. With our substantial offering, we are able to deliver an all-round, cost-effective service to our clients. Some of these services include:

All matters and litigation relating to motor vehicle accident recoveries for damages as a result of motor vehicle accidents and all third party litigation.

We offer a wide range of insurance-related services according to clients’ particular requirements. Our clients include leading South African insurance companies, as well as local brokers and other intermediaries and naturally a wide variety of policyholders. The professional staff in the team bring with them a valuable cross-section of multi-disciplinary experience that is focused to offer clients cost-effective, commercial advice.

Our team works closely with our commercial department, corporate finance and tax consultants to offer comprehensive advice on any particular structure or transaction – often developing innovative structures with an eye on the long-term regulatory environment.

The financial services industry is becoming increasingly regulated and we have extensive experience and expertise in advising on legislation. We offer advice on all aspects of insurance regulation including the Long-Term Insurance Act, the Short Term Insurance Act, the Policyholder Protection Rules as well as other relevant ancillary legislation such as the Financial Advisory and Intermediary Services Act, the Financial Intelligence Centre Act and Proceeds of Crime Act insofar as they relate to the activities of underwriters, brokers, advisers and other intermediaries and policyholders.

Our team advises on coverage opinions on all forms of liability and indemnity insurance as well as providing guidance to clients on strategic management of coverage issues. We also cover both contentious and non-contentious aspects of insurance law and will act for clients in all manners of alternative dispute resolution in a cost-effective manner.

Our team is well positioned to give advice on and draft policy wordings as well as assist in new product development from a regulatory and a policy wordings point of view. In addition, we are able to provide advice on underwriting management agreements as well as agency agreements.
